LIABILITY WAIVER, ASSUMPTION OF RISK & CONSENT AGREEMENT (UK)

This agreement applies to all activities, sessions, classes, events, and use of facilities and equipment provided by Hurlands (“Activities”).

 

1. Assumption of Risk

I acknowledge that participation in Activities at Hurlands, including but not limited to physical activity, movement-based sessions, use of facilities, equipment, changing areas, and common areas, involves inherent risks.

These risks may include physical injury, muscle strain, joint injury, falls, impact injuries, illness, fatigue, discomfort, accidents, or other physical or mental harm.

I voluntarily choose to participate and accept responsibility for risks that are inherent in these Activities. This does not include risks arising from Hurlands’ failure to exercise reasonable care.

 

2. Waiver and Release of Liability

To the fullest extent permitted by law, I agree to release, waive, and discharge Hurlands, its owners, directors, employees, instructors, contractors, volunteers, and agents from claims arising from the inherent risks of participation in the Activities.

Nothing in this agreement excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under UK law

 

3. Health and Medical Declaration

I confirm that I am physically and mentally fit to participate in the Activities and that I am not aware of any medical condition, injury, or impairment that would make participation unsafe.

 

I understand that:

  • This declaration does not replace medical advice
  • I am responsible for informing instructors of any relevant medical conditions
  • I should modify or stop participation if I experience pain, dizziness, breathlessness, or discomfort
  • I should seek medical advice if unsure about my ability to participate safely

4. Consent to Medical Treatment

In the event of an accident or medical emergency during Activities, I consent to receiving such medical treatment as is deemed necessary.

I understand that any medical or related costs incurred are my responsibility.

Where the participant is under 18, this consent is given by the parent or legal guardian.

 

5. Rules, Safety & Conduct

I agree to comply with all rules, safety guidance, instructions, booking policies, and codes of conduct issued by Hurlands and its staff, including those set out in the Terms & Conditions.

I understand that failure to comply may result in removal from Activities and/or suspension of access, in accordance with the Terms & Conditions, and may be without refund where permitted.

 

6. Personal Property

I acknowledge that Hurlands is not responsible for the loss, theft, or damage of personal belongings brought onto the premises, except where liability cannot be excluded under UK law.

I am responsible for safeguarding my own property at all times.

 

7. Photography and Recording (Optional Consent)

I consent to photographs or video recordings being taken during Activities for promotional or marketing purposes.

I understand that:

  • This consent is optional
  • I may withdraw consent at any time by notifying Hurlands in writing
  • Withdrawal of consent will not affect my ability to participate
  • The use and storage of images is handled in accordance with Hurlands’ Privacy Policy

 

8. Parent / Guardian Consent (Participants Under 18)

I confirm that I am the parent or legal guardian of the minor participant and consent to their participation in the Activities.

I acknowledge the inherent risks involved and accept responsibility for the minor’s conduct and behaviour while participating in Activities or using the facilities.

Nothing in this agreement limits Hurlands’ liability for death or personal injury caused by negligence or any other liability that cannot be excluded under UK law.

 

9. Data Protection & Privacy

I understand that Hurlands will collect and process personal data for the purposes of membership management, bookings, safety, and communication, in accordance with its Privacy Policy.

I confirm that I have read and understood the Privacy Policy and understand my rights under UK data protection law.

 

10. Relationship to Terms & Conditions

This agreement should be read alongside Hurlands’ Terms & Conditions, which govern bookings, memberships, cancellations, refunds, and use of facilities.

In the event of any conflict, statutory rights and non-excludable liabilities under UK law will always apply.

 

Governing Law

This agreement is governed by and construed in accordance with the laws of England and Wales.
